These terms govern the use of this website and the contracting of the Nuntio service. By contracting, you accept these conditions and the accompanying Data Processing Agreement (DPA), which is deemed signed in that same act.

1. Who we are#

The service is provided by Nuntio Technologies Limited, a company registered in Ireland under number 810417, with its registered office at The Black Church, St. Mary's Place, Dublin 7, D07 P4AX (Ireland). Contact: support@nuntio.ai · Tel.: +353 1 969 2059 / +353 1 233 7942.

2. The service#

Nuntio is an AI-based operational-assistance service for businesses: it answers customers, prepares quotes, manages the calendar and other tasks through the connected channels, mainly WhatsApp via Meta's WhatsApp Business Platform (official Cloud API, registered through Embedded Signup). The service is organized around an orchestrator (Nexus/Brain) that distributes the work among ten specialized Agents.

When you connect a WhatsApp number through Embedded Signup, you also accept Meta's WhatsApp Business Terms of Service directly with Meta, in addition to these terms.

The service is in private beta: some features are labelled 'coming soon' and capabilities may evolve.

3. Plans, credits and pricing#

  • Pro: €29/month — 15 credits per month (plus 3 free) and 1 WhatsApp account.
  • Max: €49/month — 25 credits per month (plus 3 free) and 2 WhatsApp accounts.
  • Ultra: €99/month — 55 credits per month (plus 3 free) and 4 WhatsApp accounts.
  • Enterprise: bespoke terms.
  • Members and organizations are capped per plan (Pro: 1 organization, 5 members each; Max: 2 organizations, 15 members each; Ultra: 4 organizations, 30 members each).
  • Paid plans are contracted by the organization's owner; members added to an organization use the free plan by default.
  • The monthly fee covers use of the platform and includes an allowance of credits, consumed according to the artificial-intelligence processing the service performs. Included credits renew each month; additional credit top-ups can be purchased.

Prices are shown in euros (EUR). Applicable indirect taxes (e.g. VAT) will be indicated before you confirm the purchase.

Charges applied by Meta for WhatsApp conversations — including the message templates used to start conversations — are billed by Meta separately and are not included in the subscription.

4. Launch promotion#

During the launch period, the first three months of subscription are 50% off. The discount applies only to the monthly subscription fee; it does not apply to credit top-ups. The promotion may be modified or withdrawn for new sign-ups without affecting those already active.

5. Payment, term and cancellation#

The subscription is monthly and renews automatically. You can cancel at any time, effective at the end of the current period; no subsequent periods will be billed. Included credits and top-ups that go unused are non-refundable and non-transferable between periods or after cancellation, unless applicable consumer law provides otherwise.

6. Right of withdrawal#

If you contract as a consumer resident in the EU, you have 14 calendar days to withdraw without giving a reason. If you expressly request that the service begin during that period, the proportion already provided may be deducted; and if the service has been fully performed with your prior consent, you lose the right of withdrawal — all in accordance with applicable consumer law. To withdraw, simply notify us unequivocally at support@nuntio.ai.

7. Acceptable use#

When using Nuntio you agree to:

  • Not use the service for unlawful purposes, spam, or non-consented communications.
  • Comply with Meta's WhatsApp Business policies (including the Business Policy and the Commerce Policy) and the terms of the other connected platforms.
  • Comply with data-protection law (GDPR) and the rules on electronic commercial communications.
  • Provide truthful information about your business (catalog, prices, opening hours) so that responses are correct.
  • Not impersonate others or mislead about the automated nature of the responses where disclosure is required.

Breach of Meta's policies or of data-protection law may result in suspension of the WhatsApp number by Meta or by us, as well as suspension or termination of the service.

8. Customer obligations regarding contacts (opt-in and opt-out)#

You are solely responsible for the contacts you address through the service and, with respect to their data, you act as the controller. In particular, you undertake to:

  • Have a valid legal basis to process your contacts' data and, where applicable, their prior, explicit, specific and independent consent (opt-in) to send them WhatsApp messages — obtained by a means other than WhatsApp and keeping proof of that consent, as required by the GDPR and Meta's policies.
  • Respect opt-out requests at all times, immediately honoring any request to stop receiving messages, including those expressed through words such as «BAJA» or «STOP», and cease directing communications to anyone who has requested it.
  • Not send communications to contacts who have withdrawn their consent or objected to receiving them, and not acquire or use contact lists without consent.

Nuntio acts on your behalf and on your instructions; the legitimacy to address the contacts belongs to your business. Nuntio may make technical mechanisms available to you to manage opt-outs, but the responsibility to obtain the opt-in and to honor the opt-out is yours.

9. Artificial intelligence: scope and limits#

Nuntio uses artificial-intelligence models. We work to make its responses reliable and, when there is reasonable doubt, the system is designed to hand the conversation over to the business owner rather than improvise. Even so, AI can make mistakes: the customer must review critical information (final prices, contractual commitments, health or legal matters) before acting on it. The service does not make automated decisions with legal or similarly significant effects on individuals within the meaning of Art. 22 GDPR.

10. Data protection and processing agreement#

With respect to the data of website visitors and of the customer account, Nuntio acts as the controller in accordance with the Privacy Policy, which details the information required by Articles 13 and 14 GDPR (purposes, legal bases, recipients, retention periods and rights).

With respect to the personal data of your business's end customers processed through the service, your business is the controller and Nuntio acts as the processor (Art. 28 GDPR), processing that data solely on your documented instructions and to provide the service, not for its own purposes; in particular, Nuntio does not read, sell, share, or use that data to train models.

These relationships are governed by the Data Processing Agreement (DPA), which forms an integral part of these conditions and is deemed signed on contracting. The DPA details the subject matter, nature and duration of the processing, the categories of data and data subjects, the confidentiality and security obligations (Art. 32 GDPR), assistance in handling data-subject rights and the breach-notification obligations (Art. 33 GDPR), the sub-processing conditions, and the deletion or return of the data at the end of the service.

Nuntio relies on sub-processors to provide the service, including Vercel Inc. (hosting and infrastructure), Meta Platforms (WhatsApp Business Platform), artificial-intelligence model providers that process the service's tasks, and the tools the customer chooses to connect (for example, Holded or Google Calendar). The customer authorizes these sub-processors on contracting and will be informed in advance of any change so as to be able to object, in accordance with the DPA.

11. International data transfers#

We prioritize processing data within the European Economic Area. Where a provider or sub-processor processes data outside the EEA, the transfer relies on appropriate safeguards under Articles 44 et seq. of the GDPR: an adequacy decision of the European Commission (including, where applicable, the EU–US Data Privacy Framework) or standard contractual clauses, supplemented with any additional measures that prove necessary.

12. Security#

We apply appropriate technical and organizational measures to protect data, in accordance with Art. 32 GDPR. These include: encryption in transit (TLS/HTTPS), encryption at rest at the infrastructure-provider level, access control restricted to authorized administrators, two-factor authentication (2FA), access logging, and minimization of the data processed. We do not claim to hold third-party security certifications (such as ISO 27001 or SOC 2); if we obtain them in the future, we will state so expressly.

WhatsApp messages travel protected by the encryption in transit that Meta's own platform applies between devices. This refers only to the transit of messages through WhatsApp and should not be confused with the encryption of data once stored in the service, which is done at rest at the infrastructure-provider level. We do not claim that stored data is end-to-end encrypted.

13. Data-subject rights#

If you are a website visitor or the holder of a customer account, you can exercise your rights of access, rectification, erasure, objection, restriction of processing and portability, as well as withdraw your consent where the processing is based on it, by writing to support@nuntio.ai. We will respond within a maximum of one month.

If you are an end customer of a business that uses Nuntio, you must direct your requests to that business, which is the controller of your data; Nuntio, as processor, will provide it the assistance needed in accordance with the DPA.

You may lodge a complaint with the Data Protection Commission of Ireland (dataprotection.ie). If you reside in Spain, you may also turn to the Spanish Data Protection Agency (aepd.es).

14. Notice for California residents (CCPA/CPRA)#

If you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the CPRA, may grant you certain rights over your personal information: to know what personal information is collected and for what purposes, to access it, to request its correction or deletion, and to opt out of its «sale» or «sharing» and to limit the use of sensitive personal information.

Nuntio does not sell or share personal information within the meaning of the CCPA/CPRA, and does not use it for purposes other than those described in these conditions and in the Privacy Policy. We do not discriminate against those who exercise their rights. You can exercise them by writing to support@nuntio.ai. With respect to the data of the end customers of a business that uses Nuntio, Nuntio acts as a service provider on behalf of that business and processes the information solely on its instructions.

15. Liability#

Nothing in these terms limits liabilities that cannot be limited by law, including the mandatory rights you have as a consumer. Otherwise, Nuntio's total liability to the customer is limited to the amounts paid for the service in the 12 months prior to the event giving rise to it.

16. Changes and applicable law#

We may update these terms by publishing the new version on this page; material changes will be communicated to active customers with reasonable notice. These terms are governed by Irish law, without prejudice to the mandatory consumer-protection rules of the consumer's country of residence.

The competent supervisory authority for data protection is the Data Protection Commission of Ireland (dataprotection.ie). If you reside in Spain, you may also turn to the Spanish Data Protection Agency (aepd.es).
